Article 1 – Definitions

The following definitions apply to these Terms & Conditions:

Right of withdrawal: the period during which the customer may exercise her right to cancel the contract. Customer: a natural person not acting for business purposes who enters into a distance contract with the seller. Day: a calendar day. Ongoing agreement: a distance contract for goods and/or services delivered or provided over a period of time. Durable medium: any medium that allows information to be stored so that it can be retrieved and reproduced unchanged in the future. Seller: the natural or legal person offering goods and/or services to customers remotely. Distance contract: a contract concluded through a remote ordering system using one or more means of distance communication up to and including the moment of conclusion. Means of distance communication: any technology that enables a contract to be concluded without the parties being physically present at the same time. Article 3 – Scope

These terms apply to all offers from Hallie & Rose and to all distance contracts concluded between Hallie & Rose and the customer.

Before the contract is concluded, the customer must have access to these terms. If this is not possible, the customer will be informed of where the terms can be found and will receive a copy free of charge upon request.

For electronic contracts, these terms are made available in a way that allows the customer to save them on a durable medium.

If specific terms apply to a particular product or service, these apply alongside the general terms. In case of conflict, the provision most favorable to the customer applies.

Article 4 – Offers

If an offer has a limited validity period or is subject to certain conditions, this will be clearly stated.

All offers are non-binding and may be changed by Hallie & Rose.

Product descriptions are accurate to the best of our knowledge and images are intended to reflect reality. Obvious errors or omissions do not bind the seller.

  • Prices (excluding any duties or import taxes payable by the customer to the carrier)

  • The process for concluding the contract
  • The right of withdrawal

Article 5 – Conclusion of Contract

A contract is concluded once the customer accepts the offer and meets the stated conditions.

For electronic orders, Hallie & Rose confirms receipt of the order promptly. Until confirmation, the customer may cancel the order.

Hallie & Rose reserves the right to verify payment details and may decline an order for legitimate reasons.

Upon delivery, the customer receives:

  • Customer service contact details
  • Information on the right of withdrawal
  • Warranty information
  • All legally required information

Article 6 – Right of Withdrawal

The customer has the right to withdraw from the contract within 30 days of receiving the goods.

During this period, the customer must handle the product with care and return it, where reasonably possible, in its original packaging.

The customer must notify Hallie & Rose of their withdrawal in writing or by email within 30 days and return the goods within 30 days of that notification.

Return shipping costs are the responsibility of the customer, including when the goods are returned directly to the supplier.

Article 7 – Return Shipping Costs

The customer bears the return shipping costs. Refunds are processed within 30 days of receipt of the withdrawal notice, provided the product has been returned or proof of shipment has been provided.

Article 8 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to goods that:

  • Were made to the customer's specifications or are clearly personalized
  • Are of a clearly personal nature
  • Cannot be returned due to their nature
  • Are perishable or have a limited shelf life
  • Are subject to market fluctuations
  • Consist of unsealed software, audio, or video recordings
  • Are hygiene products with opened packaging

It also does not apply to services that:

  • Involve accommodation, transport, or leisure activities on a specific date
  • Have begun with the customer's consent before the withdrawal period has expired
  • Relate to lotteries or betting

Article 9 – Prices

Prices will not be increased after the contract is concluded, unless required by changes in applicable taxes or other legal obligations.

Import duties and customs fees are charged by the carrier and are not included in the product price.

All prices are subject to typographical and editorial errors.

Article 10 – Conformity & Warranty

Hallie & Rose guarantees that products conform to the contract, the product description, and applicable law.

Manufacturer warranties do not affect the customer's statutory rights.

The warranty does not apply if:

  • The product was repaired by the customer or a third party
  • The product was misused
  • Care instructions or legal requirements were not followed

Article 11 – Delivery

Hallie & Rose is responsible for order fulfillment.

Delivery takes place within 30 days unless otherwise agreed. If delivery is not possible, a suitable replacement or refund will be offered.

Risk passes to the customer once the product has been received by the customer or an authorized person.

Article 12 – Duration & Cancellation

Open-ended contracts may be cancelled by the customer at any time with one month's notice. Fixed-term contracts are not automatically renewed unless explicitly agreed.

Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 business days from the start of the withdrawal period.

The customer must notify Hallie & Rose immediately of any incorrect payment details.

Article 14 – Complaints

Complaints must be submitted in writing within 7 days of identifying the issue. A response will be provided within 30 days. If more time is needed, the customer will be informed accordingly.

Article 15 – Applicable Law

All contracts between Hallie & Rose and the customer are governed by applicable law.
